On the other hand, however, it would be problematic for the credibility and thus for the desired social success of a corporate foundation if it were perceived by the public as merely an "extended arm" of an integrated CSR department; the legitimacy as a non-profit organization would be up for discussion. This master's thesis is therefore based on the following premise: Corporate foundations act in the tension between corporate and public interest. At the beginning, the challenges that a corporate foundation has to face due to its special position between the market and the non-profit sector are shown. After that, the thesis wants to explain how (potential) conflicts of interest can be solved or prevented. This is followed by the presentation of the "Ten Recommendations for Non-Profit Corporate Foundations", which were adopted by the Federal Association of German Foundations in March 2010 and aim to provide assistance for both companies and foundations. But do the "Ten Recommendations" fulfill their intended purpose? How do the representatives of German corporate foundations rate this recommendation paper?

Jörg Ultsch, Ass. iur., M.A., born 1967 in Nuremberg, 1987- Jörg Ultsch 1989 apprenticeship as a bank clerk, 1989-1994 law studies at the Friedrich-Alexander-University Erlangen-Nuremberg, 1994-1996 legal clerkship in the Higher Regional Court -Nuremberg district. With this master's thesis, he completed his two-year, part-time course "Nonprofit Management & Governance" at the Center for Social Investment (CSI) of the Ruprecht-Karls-University Heidelberg in 2010. The author has been advising and supporting sponsors, foundations and other non-profit organizations at Deutsche Bank AG since 1997. He is also a member of the committees of several non-profit organizations. In 2009 he was appointed Managing Director of Deutsche StiftungsTrust GmbH, a subsidiary of Deutsche Bank AG and the supporting body for dependent foundations.
